What Massachusetts OUI Law Actually Requires

Under M.G.L. c. 90 §24, it’s a crime to operate a motor vehicle on a public way while under the influence of alcohol, marijuana, narcotics, depressants, or stimulants, or with a blood alcohol concentration (BAC) of 0.08% or higher. Drivers under 21 face a lower threshold of 0.02%. The prosecution doesn’t need to show dangerous driving. It only needs to prove that impairment reduced your ability to operate safely.

Massachusetts is an implied consent state. When you drive here, you’re deemed to have consented to a chemical test if you’re arrested for OUI. That rule has real consequences depending on whether you took the test or refused it. Massachusetts also applies a lifetime lookback for prior OUI convictions, though the first-offender program described below remains available to true first offenders and to those whose only prior OUI was more than 10 years ago.

Penalties a First-Offense OUI Conviction Can Carry

These are the ranges the law allows for a first offense. Individual outcomes vary based on the facts of the case and how it is resolved.

• Fines: Between $500 and $5,000, plus mandatory assessments to the Head Injury Treatment Services Trust Fund and the Victims of Drunk Driving Trust Fund
• Jail exposure: Up to two and a half years, though incarceration is rarely imposed for defendants with no prior record
• License suspension: Up to one year on conviction; defendants who complete the 24D alcohol education program typically receive a reduced suspension of 45 to 90 days
• Administrative RMV suspensions: Separate from any court order; failing a chemical test and refusing a chemical test each carry their own suspension periods, with refusal carrying the longer suspension
• Drivers under 21: Face longer suspension periods and mandatory participation in a Youth Alcohol Program

The Court Process & the 24D Alternative Disposition

After a first-offense OUI arrest in Westwood, you’ll be arraigned at Dedham District Court. The charges are formally read, a not-guilty plea is typically entered, and the court addresses any bail or release conditions.
